Artículo 25. Solicitud de Licencias Particulares

(Modificado Ley 333, G.O. 9090 del 20 de julio de 1968). La solicitud de licencia particular para el porte o tenencia de armas de fuego, municiones o fulminantes se hará en los formularios que para ello disponga la Secretaria de Estado, de Interior y Policía y se formulará en triplicado dirigida a la Jefatura de la Policía Nacional, o al Gobernador Civil de la jurisdicción, según que el solicitante tenga su residencia habitual en el Distrito Nacional o en Provincia, respectivamente, acompañada de cuatro fotografías recientes de su persona, y de las certificaciones de no delincuencia expedidas por el Juez de Paz correspondiente, por el Jefe de la Policía Nacional de la Jurisdicción y por Procurador General de Apelación de su Departamento o del Procurador Fiscal de su Distrito, que evidencia que esa persona no ha sido condenada a penas aflictivas o infamantes, o a prisión temporal de más de un año por infracciones intencionales, o por delitos de robo, estafa, abuso de confianza, fullería y otros de igual naturaleza, o que no está sometida a la acción de la justicia o que no se ha dictado en su contra mandamiento de prisión alguno. Además, deberá acompañar su solicitud de un certificado médico que justifique que no ha padecido ni está padeciendo enajenación mental o de epilepsia, ni que un beodo habitual y de una Certificación de Registro de Armas de Fuego, expedida por el Intendente General del Material Bélico de las Fuerzas Armadas, la cual deberá llevar un sello de Rentas Internas del tipo de RD$1.00 (un peso) cuando sea expedida a particulares y exoneradas en casos oficiales…

Párrafo II. El Jefe de la Policía Nacional, o el Gobernador Provincial, según el caso, enviarán la solicitud al Ministerio de lo Interior y Policía, dentro del término de una semana y este funcionario podrá aprobarla o desaprobarla…

Act No. 36 of 1965, on the Commerce, Carrying and Possession of Firearms

Article 25. Request for Particular Licences

(Modified Act 333, G.O. 9090 of July 20, 1968). The application for a particular licence for the carrying and ownership of firearms, ammunition or detonators, shall be carried out using application forms provided by the State and Interior Secretary, and the Police, and shall be issued in three copies to the Command of the National Police, or the Civil Governor of the jurisdiction, depending on whether the applicant lives in the National District or in the Province, respectively, accompanied by four recent photographs of his/her self, plus certificates testifying to the absence of criminal records issued by the corresponding Peace Judge, the Chief of the National Police of the Jurisdiction and the General Appeal Prosecutor of the Department or the Fiscal Prosecutor of the District, confirming that the applicant has not been convicted of defamation or subject to punitive penalties or a temporary prison term of more than one year for intentional crimes, or crimes of theft, fraud, abuse of trust, cheating and similar acts, and is not subject to legal procedures or has not had any prison sentences against himself. The applicant shall also attach to his request a medical certificate declaring that he has not suffered from and is not suffering from mental disabilities or epilepsy, and is not an habitual drunkard, along with a Certificate from the Registry of Firearms, issued by the General Mayor of War Material of the Armed Forces, which shall include a stamp showing Internal Taxes of the RD$1.00 (one peso) type, when issued to individuals and exempted in official cases…

Paragraph II. The Chief of the National Police, or the Provincial Governor, according to the circumstances, shall issue a request to the Ministry of the Interior and Police, within the space of one week, and such offical will either approve or reject it…
