Artículo 17. Decomiso de Armas

Las armas objeto de licencia o permiso, sus accesorios (piezas, cañones de repuesto, caja o cajón de los mecanismos, cierre o cerrojo y tambor o masa) y las municiones, respecto a las que se detecte la intención de importarlas o exportarlas del territorio nacional por cualquier vía, por personas naturales o jurídicas, sin el permiso previo expedido por el Ministerio del Interior, son ocupadas y decomisadas por los funcionarios competentes de la Aduana General de la República, los que informan de inmediato al órgano de la Policía Nacional Revolucionaria que corresponda, para que lo comuniquen al órgano de Armamento correspondiente del Ministerio del Interior y este extraiga las armas del recinto aduanero y mantengan su custodia hasta tanto se disponga su destino final. De igual forma se procede con las armas y municiones prohibidas, comprendidas en el Capítulo 11 del presente Decreto-Ley.

Decree-Law No. 262 of 2008, on Arms and Ammunition

Article 17. Arms Seizure

Arms that are subject to licence or permit, their accessories (parts, spare barrels, the components of the receiver of the weapon, lock or bolt, cylinder, striker, hammer or firing pin) and ammunition, which will be imported or exported by natural or legal persons from the national territory without the prior permission from the Ministry of the Interior, will be taken and decommissioned by the competent staff of the General Customs of the Republic. [Customs] will alert the Revolutionary National Police so that they will inform the corresponding arms agency of the Ministry of the Interior who will extract the arms from the Customs area and retain them until a final destination is decided. The same shall apply for the arms and ammunition prohibited and listed in Chapter 11 of the present Decree-Law.
