Article 84

I. Le détenteur d'une arme, de munitions et de leurs éléments dont l'autorisation a fait l'objet d'un retrait ou d'un refus de renouvellement, ou qui n'a pas sollicité le renouvellement de son autorisation dans les conditions prévues au premier alinéa de l'article 49,1 s'en dessaisit dans le délai de trois mois qui suit soit la notification de la décision du haut-commissaire de la République en Nouvelle-Calédonie de retrait ou de refus, soit la date d'expiration de son autorisation. En cas de risque pour l'ordre public ou la sécurité des personnes, le haut-commissaire de la République en Nouvelle-Calédonie peut fixer un délai inférieur.

II. Le détenteur se dessaisit de l'arme, des munitions ou de leurs éléments soumis à autorisation, dans le délai prévu au I, selon l'une des modalités suivantes :

a) Vente à un armurier2 ou à un particulier dans les conditions fixées aux 1° et 2° de l'article 82;3
b) Neutralisation dans un établissement désigné par arrêté conjoint du ministre de l'intérieur, du ministre de la défense, du ministre chargé de l'industrie et du ministre chargé des douanes ;
c) Destruction par un armurier dans les conditions prévues par arrêté conjoint du ministre de l'intérieur et du ministre de la défense ;
d) Remise à l'Etat aux fins de destruction dans les conditions prévues par arrêté conjoint du ministre de l'intérieur, du ministre de la défense, du ministre de la justice et du ministre chargé du budget.

III. Le détenteur apporte la preuve qu'il s'est dessaisi de l'arme, des munitions et de leurs éléments selon l'une des modalités mentionnées au II, en adressant au haut-commissaire de la République en Nouvelle-Calédonie, au plus tard à l'expiration du délai mentionné au I, le document justificatif de ce dessaisissement.

A défaut, le haut-commissaire de la République en Nouvelle-Calédonie informe le procureur de la République…

Article 84

I. The holder of a firearm, ammunition and their components, whose authorisation was removed or if its renewal has been refused, or who did not apply for the renewal of his/her authorisation under conditions provided for in the first paragraph of Article 49,1 must surrender it within three months following either the notification of the High Commissioner of the Republic of New Caledonia decision to remove or to refuse it [the authorisation], or following the expiry date of the authorisation. In case of threats to public order or safety of the individuals, the High Commissioner of the Republic of New Caledonia may set a smaller time limit.

II. The holder surrenders the firearm, ammunition or components of firearms subject to authorisation, within the time limit provided for in I, according to the following conditions:

a) Sale to a gunsmith [dealer] or to an individual, under conditions set in 1 and 2 of Article 82;3
b) Neutralisation in an establishment selected by joint order of the Minister of interior, Minister of Defence, Minister in charge of Industry, and Minister in charge of Customs;
c) Surrender to the State with a view to destruction, under conditions provided by joint order of the Minister of Interior, Minister of Defence, Minister of Justice, and Minister in charge of the Budget.

III. The holder must prove that he/she surrendered the firearm, ammunition and their components, according to the conditions mentioned in II, by sending to the High Commissioner of the Republic of New Caledonia, no later than the expiration of the time limit mentioned in I, the justificatory document of this surrender.

Failing that, the High Commissioner of the Republic of New Caledonia informs the Procurer of the Republic…
