Chapitre II: Dérogations à l'obligation d'agrément préalable et d'autorisations d'exportation

Section 1: Dérogations en faveur de certaines opérations

Article 13:

L'agrément préalable et l'autorisation d'exportation ne sont pas exigés pour les opérations d'exportation concernant:

a) Les matériels transportés par voie ferrée en transit direct de frontière à frontière avec simple emprunt du territoire national, transbordés de bord à bord sans mise à terre (dans les ports et les aéroports de France), ainsi que les matériels transbordés de bord à bord avec mise à terre (dans les ports et les aéroports de France) dans les cas suivants:

1. Lorsqu'ils sont en provenance et à destination d'un Etat membre de l'Union européenne;
2. Lorsqu'il s'agit d'armes, munitions et leurs éléments de la 1re, de la 4e et de la 5e catégorie détenus ou portés par des personnes physiques qui changent d'aéronef ou de navire et qui ont été autorisées par leurs autorités nationales à les détenir ou les porter;
3. Lorsqu'il s'agit d'armes, munitions et leurs éléments de la 5e catégorie, soumises aux dispositions de l'arrêté du 17 juin 2009 fixant la liste des matériels de guerre et matériels assimilés soumis à une procédure spéciale d'exportation;…

b) Les matériels réexportés en suite d'admission temporaire pour essais, expériences, exposition ou démonstration, réexportés en suite d'une admission temporaire autorisée en application de l'article 721 du décret No 95-589 du 6 mai 1995, ou exportés dans le cadre du régime douanier du perfectionnement actif pour réparation, sous réserve qu'ils demeurent la propriété d'une personne établie à l'étranger et qu'ils soient réexportés à destination du propriétaire initial.

Ces régimes sont prévus pour les exportations à destination de pays tiers à l'Union européenne par le règlement (CEE) No 2913/92 du Conseil du 12 octobre 1992.

Ils sont mis en oeuvre en application du code des douanes lorsqu'il s'agit d'exportations de matériels de guerre et matériels assimilés ayant le statut de marchandises communautaires;

c) Les éléments destinés aux phases de développement, mise au point, production et entretien de matériels de guerre et matériels assimilés dans le cadre d'un accord intergouvernemental de coopération ou d'un arrangement international conclu par le ministre de la défense.

La liste de ces accords et arrangements est établie et tenue à jour par la commission interministérielle pour l'étude des exportations de matériels de guerre. Le ministre de la défense communique cette liste et éventuellement le texte des accords et arrangements au secrétariat de la commission;

d) Les armes, munitions et parachutes exportés temporairement à l'occasion de concours internationaux;

e) Les matériels exportés sous le régime douanier du perfectionnement passif pour réparation tel que ce régime est prévu par les textes cités au deuxième alinéa du b précédent. La dispense ne peut, dans ce cas, bénéficier qu'aux exportations à destination du fabricant;

f) Les fusils et carabines à canon rayé et à percussion centrale mentionnés au paragraphe 2 du II de la 5e catégorie du décret No 95-589 du 6 mai 1995 et leurs éléments ainsi que leurs munitions et les éléments de celles-ci;…

i) Les matériels de 2e catégorie réexportés en suite d'admission temporaire,…

Toutefois, à la demande de l'un des membres de la commission interministérielle pour l'étude des exportations de matériels de guerre ou d'un ministère concerné et après avis de la commission interministérielle pour l'étude des exportations de matériels de guerre, ces dérogations pourront être suspendues soit de façon générale, soit pour les expéditions à destination de certains pays nommément désignés, par un avis aux exportateurs signé du Premier ministre et inséré au Journal officiel.

Sauf dispositions contraires prévues par l'avis aux exportateurs mentionné à l'alinéa précédent, dans le cas d'une dérogation pour certains pays seulement, les expéditions qui demeurent autorisées donneront lieu, à la sortie, à la délivrance d'un acquit-à-caution ou d'une soumission garantissant l'arrivée au pays de destination et la non-réexpédition des marchandises dans un pays à destination duquel le transit, le transbordement ou la réexportation se trouvent interdits. La délivrance et la décharge de cet acquit-à-caution ou de cette soumission seront effectuées dans les conditions prévues à l'article 12.2

Article 13:

Export prior approval and authorisation are not required for export operations concerning:

a) Materials transported by train in direct transit from border to border simply passing through the country, transhipped from frontier to frontier, without touching the ground (in ports and airports of France), as well as materials transhipped from frontier to frontier, touching the ground (in ports and airports of France) in the following cases:

1. When they are coming from and going to a Member State of the European Union;
2. When it concerns firearms, ammunition and their components of the 1st, 4th and 5th categories, held or carried by individuals who are changing airplane or ship and who are authorised by their national authorities to possess or carry them;
3. When it concerns firearms, ammunition and their components of the 5th category, subject to provisions of the Order of June 17, 2009, on the List of Weapons of War and Similar Materials Subject to Special Export Procedure;…

b) Re-exported materials after temporary admission for tests, trials or exhibition, re-exported after temporary admission authorised under Article 721 of the Decree No 95-589 of May 6, 1995, or exported in the framework of the Customs regime on inward processing for repair, provided that they remain the property of a person established abroad and that they are re-exported to the original owner.

These regimes are intended for export to a third country of the European Union by Regulation (CEE) No 2913/92 of the Council of October 12, 1992.

They are implemented under the Customs Code when it concerns exports of weapons of war and similar materials in the framework of an intergovernmental agreement on cooperation or an international arrangement concluded by the Minister of Defence.

The list of agreements or arrangements is set up and kept up to date by the Inter-ministerial Commission for the Study of Exports of Weapons of War. The Minister of Defence submits this list, and eventually the agreements and arrangements, to the Secretariat of the Commissions;

d) Firearms, ammunition and parachutes that are temporarily exported for international competitions;

e) Materials exported under the Customs regime on inward processing for repair as it is provided for by texts mentioned in the second paragraph of b) of this Article. In this case, dispensation may only be granted to exports to the manufacturer;

f) Rifled and centre-fire rifles and carbines mentioned in paragraph 2 of II of the 5th category of the Decree No 95-589 of May 6, 1995 and their components, as well as their ammunition and its components;…

i) Materials of the 2nd category re-exported after temporary admission,…

Nonetheless, at the request from one of the members of the Inter-ministerial Commission for the Study of Exports of Weapons of War, or from a concerned Ministry, and after recommendation from the Inter-ministerial Commission for the Study of Exports of Weapons of War, these exemptions may be suspended either generally, or for consignments to certain designated countries, by notice to exporters signed by the Prime Minister and included in the Official Gazette.

Except as otherwise provided in the notice to exporters mentioned in the previous paragraph, in the case of an exemption for certain countries only, consignments that remain authorised will result, at the exit, in the issuance of a bond note or tender guaranteeing the arrival in the destination country and the non-re-consignment of the goods to a country in which the transit, transhipment or re-export are prohibited. The issuance and discharge of this bond note or of this tender are conducted under conditions provided in Article 12.2
