Arrêté du 31 juillet 2001 relatif à la destination des matériels de guerre, armes, éléments d'armes, munitions, éléments de munitions et autres produits explosifs appartenant à l'Etat

Article 3:

Sont remis aux établissements de la défense:

1° Les matériels de guerre des 6°, 8°, 9°, 10°, 12°, 13°, 14° et 17° de la catégorie A2;1

2° Sous réserve des dispositions de l'article 4 du présent arrêté:

a) Les matériels, armes et éléments d'armes des 2°, 3°, 4°, 7° de la catégorie A11 ou des 1°, 2°, 3°, 4°, 5°, 6°, 7° et 14° de la catégorie A2 ou de la catégorie B2 ou des a, b et c du 2° de la catégorie D,3 à l'exception de ceux en dotation dans la police nationale, qui sont remis aux secrétariats généraux pour l'administration de la police, qui procèdent ou font procéder à leur destruction;

b) Les armes et éléments d'armes du d du 2° de la catégorie D, non accompagnés d'une attestation ou sur lesquelles ne figure aucun poinçon certifiant que l'arme a été rendue définitivement impropre à l'usage par l'application d'un procédé technique garanti par un organisme officiel ou reconnu par un tel organisme;

c) Les armes et les éléments d'armes de la catégorie C4 et du 1° de la catégorie D qui ne comportent aucun poinçon officiel d'épreuve obligatoire pour les armes à feu, ou qui ne portent aucune marque de fabricant et de numéro de fabrication ou de série, ou qui présentent un défaut de fonctionnement manifeste;

3° Les munitions et éléments de munitions des 4° et 10° de la catégorie B, d'un calibre inférieur à 20 millimètres ainsi que les munitions et éléments de munitions des 6°, 7° et 8° de la catégorie C et des i et j du 2° de la catégorie D, à l'exception de ceux en dotation dans la police nationale, qui sont remis aux secrétariats généraux pour l'administration de la police, qui procèdent ou font procéder à leur destruction.

Cette remise ne donne pas lieu à contrepartie financière.

Le ministre de la défense a la libre disposition de ces matériels, armes, éléments d'armes, munitions et éléments de munitions.

Il remet à l'administration chargée des domaines les matériels de guerre des 6°, 8°, 9°, 10°, 12°, 13°, 14° et 17° de la catégorie A2 dont il n'a plus l'utilisation et qui ne sont pas inscrits sur la liste prévue à l'article 2 de l'arrêté du 27 juin 2011 relatif aux spécificités justifiant la cession par le ministère de la défense des matériels de guerre, armes et munitions.

Le ministre de la défense procède ou fait procéder à la destruction des autres matériels dont il n'a plus l'utilisation.

Order of July 31, 2001, on the Destination of Weapons of War, Firearms, Components of Firearms, Ammunition, Components of Ammunition, and Other Explosive Products Belonging to the State

Article 3:

The followings are handed over to Defence institutions:

1° Weapons of war of 6°, 8°, 9°, 10°, 12°, 13°, 14° and 17° of category A2;1

2° Subject to provisions of Article 45 of this Order:

a) Materials, firearms and components of firearms of 2°, 3°, 4°, 7° of category A1,1 or of 1°, 2°, 3°, 4°, 5°, 6°, 7° and 14° of category A2 or of category B,2 or of a), b) and c) of 2° of category D,3 except those in endowment to the National Police, which are handed over to general secretariats for administration of the Police, who proceed to, or arrange for their destruction;
b) Firearms and components of firearms of d) of 2° of category D, without a certificate or without any mark certifying that the firearm was definitively rendered unfit for use by application of technical procedures guaranteed by an official institution, or recognised by such an institution;
c) Firearms and components of firearms of category C4 and of 1° of category D, without any official and mandatory proof mark, or without any marking from the manufacturer, nor manufacturing or serial number, or which present an obvious malfunction;

3° Ammunition and components of ammunition of 4° and 10° of category B, of a calibre inferior to 20 millimetres, as well as ammunition and components of ammunition of 6°, 7° and 8° of category C and i) and j) of 2° of category D, except those in endowment in the National Police, which are handed over to General Secretariats for administration of the Police, who proceed to, or arrange for their destruction.

This does not give rise to financial compensation.

The Minister of Defence has free disposal of these materials, firearms, components of firearms, ammunition, and components of ammunition.

He [the Minister] hands over to the Administration in charge of Domains the weapons of war of 6°, 8°, 9°, 10°, 12°, 13°, 14° and 17° of category A2, which he/she no longer uses and which are not on the list provided in Article 2 of the Order of June 27, 2011, on Specificities Justifying the Transfer by the Minister of Defence of Weapons of War, Firearms and Ammunition.

The Minister of Defence proceeds to, or arranges for the destruction of the other materials that he/she no longer uses.
