Article 90:

Un résident d'un autre Etat membre ne peut acquérir des armes et leurs éléments d'arme visés au b de l'article 811 ci-dessus en vue de leur transfert que lorsque ce transfert se fait à destination de son Etat de résidence. Cette acquisition est subordonnée à la présentation du permis visé à l'article 922 ci-dessous au commissaire de police ou, à défaut, au commandant de brigade de gendarmerie compétent du lieu de l'acquisition. Ce dernier délivre un récépissé en double exemplaire du permis conformément au modèle fixé par l'arrêté prévu à l'article 121 ci-dessous.

Cette acquisition est également subordonnée à la présentation de l'accord préalable de l'Etat de résidence lorsque ce dernier l'exige. Les armes et leurs éléments d'arme visés ci-dessus ne peuvent être acquis auprès des personnes qui se livrent au commerce des armes ou de toute autre personne que sur remise dudit récépissé.

Le vendeur, après avoir complété les deux exemplaires du récépissé, en remet un à l'acquéreur et adresse l'autre à la préfecture du lieu d'acquisition; si le vendeur est un particulier, la préfecture lui délivre un récépissé de sa déclaration de vente.

Lorsqu'il transfère les armes et leurs éléments d'arme vers l'Etat de destination, l'acquéreur doit présenter au service des douanes son exemplaire du récépissé, le permis visé à l'article 922 ci-dessous et les biens transférés. Le permis visé par le service des douanes accompagne les biens jusqu'à destination. Il doit être présenté ainsi que ces biens à toute réquisition des autorités habilitées.

Article 90:

A resident from another Member State may only purchase firearms and their components referred to in b of Article 811 above with a view to their transfer when this transfer is intended to his/her State of residence. This purchase is subordinated to the presentation of a licence, referred to in Article 922 below, to the competent Commissioner of Police or, failing that, to the Commandant of the Gendarmerie of the place of purchase. The latter issues a receipt of the licence, in two copies, according to the model set by order provided for in Article 121 below.

This purchase is also subject to the presentation of prior authorisation from the State of residence when the latter requires it. Firearms and their components referred to above may only be purchased from firearm dealers or any other individual upon presentation of the said receipt.

The seller, after having completed the two copies of the receipt, gives one to the purchaser and sends the other one to the Prefecture of the place of purchase; if the seller is an individual, the Prefecture issues him/her a receipt of his/her notification of sale.

When he/she transfers the firearms and their components to the destination State, the purchaser must present to the Customs service the copy of the receipt, the licence referred to in Article 922 below, and the transferred goods. The licence, signed by the Customs services, follows the goods to their destination. It must be presented, as well as the goods, whenever requested by the competent authorities.
