Courtage

Le décret n°2002-2.3 du 3 janvier 2002, indique que les activités d'intermédiation, dont les opérations de courtage, portant sur des matériels de guerre et assimilés sont incluses dans le champ des opérations de commerce et nécessitent donc la délivrance préalable d'une autorisation de fabrication et de commerce. De fait, les courtiers agissant en France sont enregistres et doivent tenir un registre récapitulant les opérations d'intermédiation.
Un projet de loi instaurant un régime d'autorisation préalable des opérations d'intermédiation portant sur des matériels de guerre et matériels assimilés est en cours d'examen par le Parlement. Ce régime de contrôle s'appliquera aux personnes résidentes ou établies en France pour des opérations réalisées en France ou à l'étranger, et sera assorti de sanctions pénales.
Un projet de décret d'application de ces dispositions a également été élaboré.
La mise en place d'un régime de contrôle à priori des opérations d'intermédiation viendra ainsi compléter le contrôle exercé sur les personnes physiques ou morales agissant comme intermédiaires.

Brokering
i) What national legislation or administrative procedures exist to regulate the activities of those who engage in SALW brokering within national jurisdiction and control? (e.g. registration of brokers, licensing or authorization of brokering transactions and appropriate penalties) (II.14)
Decree 2002-2.3 of 3 January indicates that intermediation activities, including brokering activities, concerning weapons of war and similar goods are included in the field of trade operations and thus require prior issuance of an authorisation to manufacture or trade. Therefore, brokers operating in France are registered and must keep records summarising intermediation operations.
A bill for a law establishing rules on prior authorisations of intermediation operations concerning weapons of war and similar goods is currently being examined by the Parliament. These rules on control will apply to individuals who reside or are established in France for operations carried out in France or abroad, and will be accompanied by criminal penalties.
Another bill for a decree on these provisions has been elaborated.
Setting up rules for control prior to the intermediation operations will thus complete the control over individuals and companies acting as intermediaries.
