Registro y Rastreo de las Armas

Ley 25.938

Mediante la sanción de la Ley 25.938 se creó un Registro bajo competencia de este Registro Nacional de Armas en el cual se asientan los datos correspondientes a las armas de fuego, sus partes y repuestos, municiones y demás materiales controlados incluidos en la ley Nacional de Armas y Explosivos y sus reglamentaciones, que hayan sido secuestrados o incautados por los Poderes Judiciales Nacional y Provinciales, Fuerzas de Seguridad, Policía Federal Argentina y Policías Provinciales, y demás organismos competentes…

En cuanto a la implementación de la ley N° 25.938 el Registro Nacional de Armas ha gestionado con los Poderes Ejecutivos provinciales, las Supremas Cortes de Justicia provinciales y los diferentes Poderes Legislativos provinciales la adhesión a la misma, resultando Jujuy, Formosa, Chaco, Corrientes, Buenos Aires, La Pampa, Mendoza, Rio Negro, Tierra del Fuego, Ciudad Autónoma de Buenos Aires, San Juan, Santa Fe y Neuquen. Se encuentran en vías de adhesión las provincias de Salta, Córdoba y Entre Ríos.

El total de armas destruidas, durante el transcurso del año 2009, en el marco de la Ley N° 25.938 fue de mil ochocientas ochenta y cuatro (1884).

Teniendo en cuenta la normativa vigente con relación a los legítimos usuarios, la regulación de la producción, comercialización interna, exportación, importación, transite y destrucción de las armas, así como la reglamentación aplicable para la correcta identificación de las armas, se obtiene un registro adecuado par a el correcto y fehaciente rastreo de las armas de fuego. El Estado argentino exige que los registros de armas de fuego en poder de empresas que cesen en su actividad sean entregados al RENAR de conformidad con la legislación vigente.

El Registro es un Banco Nacional Informatizado de Datos a cargo del RENAR y fue puesto en funcionamiento en el año 1993. El mantenimiento de la información es por tiempo indefinido y centralizado.

Por su parte, a partir de la adopción de la Ley 25.938 sobre Armas incautadas, la Argentina cuenta con una herramienta fundamental para poder establecer los posibles desvíos de las armas hacia el mercado ilegal, identificado su último usuario legal. (se amplía en punta 6).

Respecto de las disposiciones del instrumento sobre rastreo y marcaje en materia de cooperación y asistencia, se destaca que la Argentina se encuentra en condiciones de prestar asistencia técnica, bilateral y multilateral, previa petición de las autoridades competentes, en el fomento de la capacidad nacional en las áreas de la marcación. El mantenimiento de registros y el rastreo para apoyar la aplicación efectiva del instrumento par parte de los Estados. Respecto de iniciativas adoptadas a nivel subregional en materia de rastreo, ver Sección 11 (A nivel regional) respecto de los instrumentos adoptados en el ámbito del MERCOSUR y Estados Asociadas.

Registration and Tracing of Weapons

Law 25.938

Through the approval of Law 25.938, a register was created under the purview of the National Arms Registry in which data is recorded for firearms, their parts and spare parts, ammunition, and other material included in the National Firearms and Explosives Act and its regulations, which have been seized or confiscated by the National and Provincial Judiciaries, the Security Forces, the Argentine Federal and Provincial Police, and other agencies…

As for the implementation of Law No. 25.938, the National Arms Registry has administered the Provincial Executive Authorities, the provincial legislatures of the Supreme Court, and the different Provincial Legislative Powers which are in support, including the provinces of Jujuy Formosa, Chaco, Corrientes, Buenos Aires, La Pampa, Mendoza, Rio Black, Tierra del Fuego, City of Buenos Aires, San Juan, Santa Fe and Neuquen. There is also support in the provinces of Salta, Córdoba y Entre Ríos.

Under Law No. 25.938, the total number of weapons destroyed during the course of 2009 was one thousand eight hundred and eighty four (1,884).

The regulations in force concerning lawful users, the production, domestic sale, export, re-export, import, transit, destruction and correct identification of weapons make it possible to maintain a suitable register for the correct and reliable tracing of firearms. The Argentine State requires that registers of firearms in the possession of enterprises terminating their operations must be turned over to RENAR in accordance with the legislation in force.

The register is a RENAR computerised national database, which has been in operation since 1993. The information is stored indefinitely in a central location.

Since the adoption of Act No. 25.938 on confiscated weapons, Argentina has had a fundamental tool enabling it to determine if arms are being diverted to the illegal market and to identify the most recent lawful user (see point 6 for further details).

With regard to the provisions on cooperation and assistance in tracing and marking arms contained in the International Instrument to Enable States to Identify and Trace, in a Timely and Reliable Manner, Illicit Small Arms and Light Weapons, Argentina is able to render bilateral and multilateral technical assistance, upon request from the competent authorities, in building national capacity in the areas of marking, record-keeping and tracing, to support the effective implementation of the Instrument by States.
