Artículo 8. Armas de Guerra o de Uso Privativo de la Fuerza Pública

Son armas de guerra y por tanto de uso privativo de la Fuerza Pública, aquellas utilizadas con el objeto de defender la independencia, la soberanía nacional, mantener la integridad territorial, asegurar la convivencia pacífica, el ejercicio de los derechos y libertades públicas, el orden constitucional y el mantenimiento y restablecimiento del orden público, tales como:

a) Pistolas y revólveres de calibre 9.652mm. (.38 pulgadas) que no reúnan las características establecidas en el artículo 11 de este Decreto;

b) Pistola y revólveres de calibre superior a 9.652mm. (.38 pulgadas);

c) Fusiles y carabinas semiautomáticas de calibre superior a 22 L.R.;

d) Armas automáticas sin importar calibre…

i) Armas que lleven dispositivos de tipo militar como miras infrarrojas, laséricas o accesorios como lanzagranadas y silenciadores;

j) Las municiones correspondientes al tipo de armas enunciadas en los literales anteriores.

Article 8. Weapons of War or for the Sole Use of the Security Forces

Weapons of war and therefore for the sole use of the security forces are those which are used in order to defend independence and national sovereignty, maintain territorial integrity, ensure peaceful coexistence, the exercise of rights and public freedoms, constitutional order and the maintenance and restoration of public order, such as:

a) Pistols and revolvers of 9.652mm. calibre (.38 inches) which do not meet the specifications of Article 11 of this Decree;

b) Pistols and revolvers of calibre superior to 9.652mm. (.38 inches);

c) Semi-automatic rifles and carbines over .22 calibre LR;

d) Automatic arms of all calibres…

i) Arms with military-style devices such as infrared and laser sights or accessories such as grenade launchers and silencers;

j) Ammunition for the arms described in the previous paragraphs.
