Artículo 57. Requisito Previo a la Venta de Armas Permitidas

Los establecimientos autorizados para la venta de armas permitidas, de previo a comercializarlas, solicitarán al Departamento el permiso de venta para cada arma en particular, para lo cual deberá adjuntar los siguientes requisitos:

a. Solicitud formal de venta del arma de fuego, la cual debe contener como mínimo: nombre, apellidos, número de cédula, calidades, nacionalidad y domicilio del posible comprador.

Las características del arma de fuego, sea: marca, calibre, tipo, modelo y número de serie. Nombre del negocio autorizado para la venta, así como el nombre de su representante, quien firmará dicha solicitud.

b. Fotocopia de la cédula del posible comprador, aportando a su vez, el nombre y apellidos del padre y la madre.
c. Fotocopia de la factura proforma.
d. Una fotografía tamaño pasaporte.
e. Original del examen psicológico o psiquiátrico, donde conste que es apto para poseer armas de fuego.
f. Fotocopia del carné o certificación que lo acredite haber ganado el curso teórico-práctico de manejo de armas de fuego, extendido por el Departamento.
g. Un juego de timbres para certificación.

En caso de que el comprador sea una persona jurídica, tendrá que presentar una certificación de la cédula jurídica.

Si el objeto de la persona jurídica consiste en realizar funciones de seguridad privada … la persona que ostenta la representación legal tendrá que presentar el examen psicológico cada dos años.

El Departamento solicitará al archivo judicial de delincuentes un certificado de antecedentes penales. En el caso de las personas jurídicas, se solicitará a nombre de su representante legal. Lo anterior a efecto de verificar que la persona no haya sido condenada por delitos relacionados con el uso de armas, según lo exige el inciso b) del numeral 22 de la Ley N° 7530.

El Departamento deberá resolver la gestión presentada dentro de los cinco días siguientes …

Article 57. Prerequisite for the Sale of Permitted Arms

Authorised gun shops must request permission for the sale of each firearm to the Arms and Explosives Control Department. To apply for the permit it must comply with the following requirements:

a. Formal request for the sale of a firearm, which must contain: name, ID number, nationality and address of the prospective buyer.

Characteristics of the firearm: brand, calibre, type, model and serial number. Name of the authorised gun shop and name of its representative, who will sign the request

b. Photocopy of the ID card of the prospective buyer and name of his/her father and mother.
c. Photocopy of the proforma invoice.
d. One passport size photograph.
e. Original psychological or psychiatric test showing that the prospective buyer is eligible to possess firearms.
f. Photocopy of the certificate attesting that the prospective buyer has approved the theoretical-practical firearm handling test, issued by the Department.
g. The corresponding taxes.

If the buyer is a legal entity, the corporate identification card must be submitted.

If the legal entity is a private security company … its legal representative must approve the psychological test every two years.

The Department will request a criminal record certificate to the Judicial Archives of criminals. In the case of legal entities, the criminal record certificate of its legal representative will be requested. This will be done to verify that the person has not been convicted of any offense described in paragraph b) of Article 22 of the Law 7530.

The Department must process the application within the next five days …
