Executive Summary

In the context of the contemporary gun control debate the question has been asked whether there is an individual right to bear arms in New South Wales.

The claim that such a right exists is usually said to be based on Article 7 of the UK Bill of Rights 1689.

This Briefing Paper considers the various historical and constitutional questions at issue, and concludes that Article 7 of the Bill of Rights is little more than an historical curiosity.
