Export Controls

Current Belarusian legislation on State regulation of the import and export of specific items (goods, services) provides the necessary legal framework for control of small arms and light weapons.

In accordance with the legislation, legal persons of the Republic of Belarus require a license to engage in foreign trade transactions involving small arms and light weapons or to provide brokering services relating to the transfer of small arms and light weapons from one foreign State to another.

A license for engaging in foreign trade in small arms and light weapons may be issued to a legal person of the Republic of Belarus only if that entity has obtained, through the established procedure, certification of its entitlement to engage in foreign trade in specified goods.

The names of legal persons of the Republic of Belarus which have obtained certification of their entitlement to engage in such activities are included in the corresponding register.

The State Military and Industrial Committee is responsible for maintaining the register and issuing certificates and licences.

The State Military and Industrial Committee of the Republic of Belarus issues licences on the basis of decisions of the Inter-Departmental Commission on Military and Technical Cooperation and Export Controls of the Security Council of the Republic of Belarus. According to a decision by the Commission, the documents submitted for the license application are approved by the national State authorities (usually by the Ministry of Defence, the Ministry of Foreign Affairs and the State Security Committee).
