Modificación a la Directriz Nº 1 del 10 de Enero del 2012: Disposiciones Administrativas Necesarias para el Control y Fiscalización de las Armas

POR TANTO:

Se modifica la directriz número 1º del 10 de enero del 2012 emitida por este Despacho, y en su lugar se ordena a la Dirección General de Armamento, al Departamento de Control de Armas y Explosivos y a la Dirección de Servicios de Seguridad Privada, acatar las siguientes disposiciones administrativas mínimas necesarias para el efectivo control y cumplimiento de la Ley Nº 7530:

1) Las personas físicas pueden inscribir para su seguridad personal, la de su familia y su patrimonio tres armas de fuego, conforme lo establece el artículo 231 de la Ley de Armas y Explosivos.

2) Se denegará la solicitud de cambiar de uso el arma de fuego, si es matriculada para seguridad personal deberá mantenerse bajo esta modalidad. La solicitud de matrícula y portación de otra arma de fuego bajo esta premisa debe ser denegada.

3) Cuando un arma sea traspasada entre particulares no se modificará la inscripción de la misma hasta tanto el adquirente cumpla con el proceso de inscripción por lo cual quedará a nombre del enajenante…

6) Únicamente podrán matricular armas de fuego destinadas a la cacería, al tiro al blanco o al plato, aunque sean del mismo calibre, las personas físicas. Sin embargo, en lo que respecta a las personas jurídicas, queda a criterio del Departamento de Control de Armas y Explosivos la aprobación de un máximo de hasta cinco armas de fuego destinadas a la cacería, al tiro al blanco o al plato.

7) Se denegará la inscripción y portación de armas de fuego a personas con antecedentes penales o policiales por los delitos contra la propiedad, violencia doméstica, delitos contra la vida, delitos contra la libertad, e infracción a la Ley de Estupefacientes, Sustancias Psicotrópicas, Drogas y Actividades Conexas. A solicitud del administrado el Departamento podrá valorar casos específicos resolviéndolos mediante resolución ampliamente fundamentada. Lo anterior con el fin lograr una disminución en el uso indebido de las mismas para fines diversos a la protección, uniéndose a ello la necesidad de que el legítimo propietario posea conocimientos y destrezas que lo acrediten como un usuario responsable, considerando en este momento que antecedentes, como los mencionados no dan seguridad al Estado sobre un uso responsable del arma de fuego…

Amendment to the Directive No. 1 of January 10, 2012: Administrative Provisions for the Control and Monitoring of Firearms

Therefore:

Directive No. 1 of January 10, 2012, issued by this Office, is modified and it is ruled that the Armaments Directorate, the Department for the Control of Arms and Explosives and the Directory of Private Security Services must comply with the following administrative provisions necessary for the effective control and compliance of Act No. 7530:

1) Individuals may register, for their personal security, that of their family and their properties, three firearms, in accordance with what Article 231 of the Act of Firearms and Explosives establishes.

2) Any request to change the intended use of a firearm shall be rejected, if the firearm is registered for personal use it shall be maintained as such. Any request to register and carry another firearm under the same modality must be rejected.

3) Whenever a firearm is transferred between individuals, the registration of the latter shall not be modified until the purchaser complies with the registration, which shall be kept under the name of the original holder…

6) Only individuals may register firearms destined for hunting, target or clay shooting, even if they are of the same calibre. Nevertheless, regarding legal persons, it shall be up to the Department for the Control of Arms and Explosives to approve up to five firearms destined for hunting, target or clay shooting.

7) The registration and carrying of firearms shall be denied to any individual with criminal or police records for crimes against property, domestic violence, crimes against life, crimes against freedom and any violation to the Act on Narcotics, Psychotropic Substances, Drugs and Related Activities. By request of the administrator the Department may assess specific individual cases via a duly documented review. The purpose of the above is to diminish the number of firearms put to uses other than protection, as well as to ensure that the lawful owner has the necessary knowledge and skills to accredit him as a responsible user, given that records of the kind mentioned above do not guarantee the State that he shall use a firearm responsibly…
