Article R. 314-18

La personne qui a transféré la propriété d'une arme, d'un élément d'arme et de munitions peut acquérir une arme, un élément d'arme et des munitions de remplacement classés dans la même catégorie, à condition de procéder à une acquisition dans le délai prévu à l'article R. 312-12.1

Ce délai court soit de la date d'annulation de l'acquisition de l'arme transférée soit de la date de remise du volet n° 1 au bénéficiaire du transfert.

Selon que cette nouvelle acquisition est réalisée auprès d'un commerçant autorisé ou auprès d'un particulier, le commerçant ou le commissaire de police ou le commandant de brigade de gendarmerie adressent au préfet toutes indications nécessaires à la mise à jour du volet n° 2 détenu par celui-ci.

Article R. 314-18

An individual who transfers the ownership of a firearm, firearm components or ammunition, may purchase a replacement firearm, firearm components or ammunition listed in the same category, providing that the purchase is done within the time limit provided for in Article R. 312-12.1

This time limit runs either from the date of cancellation of the purchase of the transferred firearm or from the date of the handing of section No. 1 to the beneficiary of the transfer.

Depending on whether this new purchase is made in the presence of an authorised dealer or of an individual, the dealer or the Commissioner of Police or the Commander of Gendarmerie must send to the Prefect all necessary information to update section No. 2 [of the authorisation or receipt of acquisition and possession of the beneficiary].
