Le préfet peut également, avant de statuer, s'il l'estime nécessaire, demander à l'agence régionale de santé de l'informer, dans le respect des règles du secret médical, de l'éventuelle admission en soins psychiatriques sans consentement dans un établissement de santé mentionné à l'article L. 3222-1 du code de la santé publique ou de l'éventuel traitement dans un service ou secteur de psychiatrie d'un demandeur qui n'a pas produit le certificat médical prévu au deuxième alinéa de l'article L. 312-61 du présent code. Si ces informations confirment que le demandeur aurait dû joindre ce certificat à sa demande, le préfet lui demande de le produire sans délai ou d'apporter tous éléments de nature à établir que sa demande n'est pas soumise aux dispositions de cet article.

Article R. 312-8

The Prefect may also, before deciding [on the authorisation request], if he deems necessary, ask the Regional Health Institution to inform him, according to the rules relating to medical confidentiality, of the eventual admission into psychiatric care without consent in a health institution, as referred to in Article L. 3222-1 of the Public Health Code, or the eventual treatment in a psychiatric service or department of the applicant who has not provided the medical certificate provided for in the second paragraph of Article L. 312-61 of this Code. If this information confirms that the applicant should have provided this certificate with his application, the Prefect shall request that it is provided without delay or to provide all elements to prove that his request is not subject to provisions of this article.
