Artículo 98. Prohibiciones generales de transferencia e intermediación

Para los fines o efectos de la presente Ley, se prohíbe la transferencia, importación, exportación, tránsito e intermediación de cualquier tipo de armas, sus piezas y componentes o municiones, relativo a:

a. Aquellos países con los cuales el Estado de Guatemala tenga diferendos o conflictos limítrofes;

b. Los Estados a los cuales Naciones Unidas les ha establecido embargo;

c. Los Gobiernos que violen sistemáticamente los derechos humanos;

d. Los países que fomentan el terrorismo y el crimen o que sirven de refugio a narcotraficantes;

e. Los casos en que se presume o existen indicios que:
1. Estas armas, sus piezas y componentes o municiones se usarán en actos de genocidio o crímenes de lesa humanidad y/o violaciones de los derechos humanos, en contravención del derecho internacional;
2. Estas armas, sus piezas y componentes o municiones respalden actos terroristas y/o grupos armados irregulares;
3. Se transgrede acuerdos bilaterales y multilaterales sobre el control o la no proliferación de armas…

Article 98. General Prohibitions on Transfer and Brokering

Under this Act, the transfer, import, export, transit and brokering of any firearms, their parts and components or ammunition are prohibited with regards to:

a. Those countries with which the State of Guatemala has border disputes or conflicts;

b. Countries placed under embargo by the United Nations;

c. Governments that systematically violate human rights;

d. Countries that promote terrorism and crime or serve as a refuge for drug traffickers;

e. Cases where the following incidents are presumed or have taken place:
1. These firearms, their parts and components or ammunition have been used in acts of genocide or crimes against humanity and/or human rights, in contravention of international law;
2. These firearms, their parts and components or ammunition support acts of terrorism and/or armed groups;
3. Violation of bilateral and multilateral agreements on the control and non-proliferation of firearms…
