Artículo 55. Requisitos para Personas Naturales - Autorización de Compra

Las personas naturales que deseen obtener una Autorización de Compra e inscripción de armas, previamente deberán cumplir con lo siguiente:

a) Selección del tipo de arma, calibre y casa comercial donde realizará la compra, antecedentes que presentará ante la Autoridad Fiscalizadora, la cual verificará el cupo disponible para inscripción, dispondrá el exámen de conocimientos del interesado y controlará la documentación, conforme a lo establecido en el artículo N° 76° del presente reglamento.

b) Una vez aprobado lo anterior, la Autoridad Fiscalizadora emitirá una Solicitud de Autorización de Compra e Inscripción. Este documento tendrá una validez de 10 días corridos, y certificará que el interesado cumple con los requisitos correspondientes, a fin de continuar con el proceso para obtener la Autorización de Compra y concretar el negocio con el comerciante donde realizó la cotización.

c) El usuario o su mandatario designado mediante un poder notarial, presentará ante la Autoridad Fiscalizadora todos los antecedentes, incluyendo fotocopia del Certificado de Asistencia Técnica, y además, cancelando la tasa de derechos correspondiente a la inscripción del arma.

La Autoridad Fiscalizadora emitirá la Autorización de Compra, que tendrá una validez de 10 días corridos, inscribiendo el arma, descargando los productos de los inventarios del comerciante y entregará en este acto el Padrón de Inscripción.

d) El comerciante sólo entregará el arma cuando el usuario certifique la inscripción de ésta, presentando el Padrón respectivo.

e) La Autorización de Compra de armas y municiones, servirá como Guía de Libre Tránsito, para el transporte entre la armería y el bien raíz fijado en la inscripción del arma. Su validez para retirar y realizar el traslado del arma, será el de la Autorización de Compra.

En caso que haya caducado la Autorización de Compra y el interesado no hubiese efectuado el traslado del arma, deberá solicitar una Guía de Libre Tránsito ante la Autoridad Fiscalizadora respectiva.

La solicitud de Autorización de Compra e inscripción, servirá exclusivamente para ser utilizada en la casa comercial para la cual fue otorgada, y la adquisición deberá corresponder a los productos y cantidades establecidas en este documento.

Article 55. Requirements for Natural Persons - Sales Authorisation

Individuals wishing to obtain a Sales Authorisation and registration of their firearms, shall first comply with the following requirements:

a) Selection of the type of firearm, calibre and business place where the applicant shall carry out the purchase, provide his background checks to the Control Authority, verify the quotas available for registration, conduct the test on the applicant's knowledge and verify his documentation, in accordance with article 76 of the present regulation.

b) Once the above is approved, the Control Authority shall issue an Authorisation Request for Sale and Registration. This document shall be valid for 10 calendar days, and shall certify that the applicant complies with all the corresponding requirements in order to continue with the process of obtaining a Sales Authorisation and to conclude the transaction with the dealer from whom he obtained the price.

c) The client or his representative appointed through a notary act shall provide the Control Authority with all his background checks, including a photocopy of the Certificate of Technical Assistance, and eventually his payment of the firearm registration fees.

The Control Authority shall issue the Sales Authorisation, which shall be valid for 10 calendar days, registering the firearm and remove the products from the dealer inventories, and shall finally record this act in the Registration Register.

d) The dealer may only release the firearm once the client has certified its registration, in the respective Register.

e) The Sales Authorisation for firearms and ammunition shall serve as a Free Transit Permit, for the transport between the armoury [gun-shop] and the residence stated in the firearm registration [document]. Its validity to collect and carry out the firearm transaction shall be the same as the Sales Authorisation.

Should the Sales Authorisation expire when the applicant is yet to transfer the weapon, he shall request a Free Transit Permit to the corresponding Control Authority.

The request for an Authorisation for the Sale and Registration shall exclusively be used in the business place for which it was handed over, and the purchases shall match the products and quantities listed in this document.
